Contest Rules

How to Enter:

Each person who registers online at www.cactusclubcafe.com for The Cactus Dish e-newsletter (the “Newsletter”) during the one-year period following the launch of the Newsletter (the “Contest Period”) will automatically be entered in a contest to win one of four prizes (the “Contest”). By registering for the Newsletter during the Contest Period, individuals agree to abide by these Rules.

Limit of one entry per person. If it is discovered that a person has registered for the Newsletter more than once, such person shall not be eligible to win the Contest. Entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted. “Authorized account holder” means the natural person who is assigned to the e-mail address by an Internet access provided, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Although online access and an e-mail account are required in order to register for the Newsletter and participate in the Contest, no purchase of any kind is necessary and no cost or fee is applicable.

Prizes:

Four prizes are available to be won. Each prize consists of a Cactus Club gift card in the amount of $500, which gift card is subject to the terms and conditions provided thereon. Prizes are not convertible to cash and must be accepted as awarded. Cactus Restaurants Ltd. (“Cactus”) reserves the right, in its sole discretion, to substitute a prize of equivalent or greater value. Each entrant is eligible to win one prize only.

Draws:

Four separate random draws will be made by a Cactus representative at Cactus’ head office, with one prize to be won in each such draw.

The first draw will be made at 12:00 pm PST on the last day of the first quarter of the Contest Period from all eligible entries received on or before 6:00 pm PST on immediately preceding day (the “First Draw Deadline”).

The second draw will be made at 12:00 pm PST on the last day of the second quarter of the Contest Period from all eligible entries received between the First Draw Deadline and 6:00 pm PST on the immediately preceding day (the “Second Draw Deadline”).

The third draw will be made at 12:00 pm PST on the last day of the third quarter of the Contest Period from all eligible entries received between the Second Draw Deadline and 6:00 pm PST on the immediately preceding day (the “Third Draw Deadline”).

The fourth and final draw will be made at 12:00 pm PST on the last day of the Contest Period from all eligible entries received between the Third Draw Deadline and 6:00 pm PST on the immediately preceding day.

Selection Process:

Each selected entrant will be contacted by e-mail and, in order to win, must first correctly answer a time-limited mathematical skill-testing question and sign (i) a declaration of compliance with these Rules and acceptance of the prize as awarded, and (ii) a publicity/liability release consenting to the use of his or her name, photo and/or statements in any Contest-related publicity, without compensation other than the prize offered, and releasing Cactus and its respective directors officers, agents and representatives from liability.

If a selected entrant does not respond within 10 days of the relevant draw, the skill-testing question is answered incorrectly, the required declaration and release are not received within the prescribed period, or if a potential winner does not comply with these Rules, is deemed ineligible for any reason, or wishes to withdraw his or her name from the Contest, the prize will be forfeited and an alternative entry will be drawn until the prize is awarded in accordance with these Rules.

The chances of being selected depend upon the total number of eligible entries received.

Eligibility:

Selected entrants must be registered for the Newsletter at the time of the draw.

The Contest is open only to residents of British Columbia and Alberta who have reached the age of majority, which is 19 years of age in British Columbia and 18 years of age in Alberta, except employees of Cactus and its affiliated companies and their representatives, agents, advertising and promotional agencies, the Contest judges, and all persons domiciled with any of the foregoing.

Eligibility for the Contest is limited to those persons with prior existing internet connections or those persons who did not pay to use the internet specifically for the purpose of registering for the Newsletter in order to enter the Contest. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free e-email accounts.

Personal Information:

To register for the Newsletter, individuals are required to provide their first and last name and e-mail address. Such information will be used to administer the Newsletter and the Contest and in connection with any publicity relating to the Contest. Cactus will also use such information to provide registrants with information about its products, services and promotions and with advertising and marketing material which Cactus believes may be of interest. All entries become the property of Cactus.

General:

Cactus shall not be responsible for (i) entries which are late, incomplete or misdirected; (ii) telephone, technical, network, online, electronic, computer hardware or software failures of any kind; (iii) incomplete, garbled or delayed Internet/e-mail computer transmissions on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof; (iv) any condition caused by events beyond its control which disrupts or interferes with the Contest; or (v) any injury, loss or damage of any kind arising out of participant's participation in the Contest or the acceptance, possession or use of a prize, including without limitation any injury or damage to participant's or any other person's computer or other device relating to or resulting from participation in the Contest or registering for the Newsletter or from downloading any materials in connection therewith.

Cactus makes no representations or warranties in respect of the Contest. If for any reason the Contest is not capable of running as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond its control, Cactus reserves the right to, without prior notice, cancel, terminate, modify or suspend the Contest or any portion thereof.

The Contest is subject to all applicable federal, provincial and municipal laws. The decisions of Cactus in all matters relating to the Contest shall be final.
